These terms are an agreement between you and Pixelfed Inc. ("we", "us"), a company based in Alberta, Canada. They cover the Sup apps, Sup Server, this website and the waitlist (together, "Sup"). By using Sup you agree to them. Our Privacy Policy explains how we handle your data.
Who can use Sup
You must be at least 16 years old, and old enough to agree to these terms where you live. If you use Sup for an organisation, you confirm you're allowed to accept these terms on its behalf.
Your fediverse account
Sup works with an account on a fediverse server that you choose. That server is run by someone else and has its own rules, which also apply to what you do through Sup. We aren't responsible for other servers, their availability, or how they treat your data. You're responsible for keeping your account secure, and for everything done through Sup with it.
The waitlist
- Joining the waitlist doesn't guarantee access to Sup, or access by any particular date. Places are offered roughly in the order people verified, but we may adjust timing, for example to pace invites per server.
- A spot belongs to the account that earned it and can't be transferred or sold.
- To verify, you publish a public post from your account. You can edit the text. Keeping it up for 7 days locks your spot. After that you can delete it.
- We may remove signups that use fake, automated or bulk-created accounts, or that otherwise try to game the line.
- Referral links are tracked so we can suggest people you know later. They don't affect your place in line.
Early access
Early versions of Sup are unfinished. Features may change or disappear, things will break, and data may occasionally be lost. Please don't rely on early versions for anything critical, and let us know when something goes wrong.
Your content
You own what you send through Sup. To run the service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, transmit and display your content to the people you send it to, and to process it as described in our Privacy Policy. This licence ends when your content is deleted from Sup, except for copies already delivered to other people or servers.
Messages in Sup version 1 are not end-to-end encrypted. Don't use Sup for anything you wouldn't want to be stored on a server.
Acceptable use
Don't use Sup to:
- break the law, or help someone else break it;
- harass, threaten, dox or abuse anyone;
- share child sexual abuse material. We have zero tolerance for it and report it to the authorities;
- share content that promotes violence, terrorism or hatred against people for who they are;
- send spam, scams, phishing, or unsolicited bulk messages;
- impersonate people or organisations in a misleading way;
- distribute malware, or attack, overload, probe or reverse engineer Sup's servers;
- scrape Sup or get around rate limits, blocks or other protections;
- infringe anyone's intellectual property or privacy.
Moderation and enforcement
You can report people and messages in the app. We review reports and may remove content, limit features, or suspend or end access to Sup for accounts that break these terms or put others at risk. Where we can, we'll tell you why. Your fediverse server may also act on reports under its own rules, and we may share relevant reports with it.
Third-party services
Sup relies on services we don't control, including your fediverse server, the servers of the people you talk to, and Klipy for GIFs. Their terms apply when you use them, and we aren't responsible for them.
Our rights
The Sup name, logo and apps belong to Pixelfed Inc. Where parts of Sup are released as open source, the licence for that code applies to it.
Fees
Sup is free during early access. If we introduce paid features later, we'll tell you in advance and you won't be charged unless you choose them.
Ending things
You can stop using Sup and delete your account at any time. We may end or suspend your access if you break these terms, if required by law, or if we discontinue Sup, in which case we'll give reasonable notice where we can so you can export your messages.
Disclaimers
Sup is provided "as is" and "as available". To the extent the law allows, we make no warranties, including that Sup will be uninterrupted, error-free or secure, or that messages will always be delivered. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.
Limitation of liability
To the extent the law allows, Pixelfed Inc. isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Sup. Our total liability for any claim relating to Sup is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $100.
Indemnity
If someone brings a claim against us because of content you sent or your breach of these terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Disputes go to the courts of Alberta, unless the law where you live gives you the right to bring them somewhere else.
Changes
We may update these terms. We'll change the date at the top, and for significant changes we'll tell you in the app or by direct message before they take effect. If you keep using Sup after that, the new terms apply.
